BLUE-JOBS (Hereinafter BLUE-JOBS), is an online platform for job searching in the marine and maritime sectors. The present conditions expose the rights and obligations of the user and of BLUE-JOBS as the provider of the service.

BLUE-JOBS will assume that any user who uses the platform and the services has read and accepted the conditions of use, and BLUE-JOBS reserves the right to update and modify the Terms of Use without any prior notice, which are always available at www.blue-jobs.com.

BLUE-JOBS, whose owner is Blue Economy and Recruitment Consultancy Sociedad Limitada with Tax Identification Number 0B56892508 and domiciled at Calle Lepant 270, Entresuelo, 1, Barcelona (Spain), provides the BLUE-JOBS Web Site and its related services according to the terms and conditions set forth below.

This agreement will be valid from the date you check the box for acceptance of this agreement. New features that could be added to the Services will be subject to the Terms of Use. In case the user continues to make use of the Service after any modification, it will assume their agreement with said modifications. Failure to comply with any of the Conditions of Use may lead to the cancellation of your account.

General terms

The user is fully responsible for the access and correct use of BLUE-JOBS subject to the current legality, whether national or international, as well as the principles of good faith, morality, good customs, and public order. And specifically, it acquires the commitment to diligently observe the present General Conditions of use.

The user agrees not to resell, duplicate, reproduce or exploit any part of the Service without the express written consent of BLUE-JOBS. You may not use the Service to store, host, or send harmful or unsolicited (spam) e-mail.

You understand that the Service may be used for the transmission of your Content and that during this process, your Content, including invoices, payment notices, and personal messages, may be transferred unencrypted through the Internet. The user cannot use the service to transmit any virus, worm, or any type of malicious or harmful content.

BLUE-JOBS makes no warranties with respect to its ability to use the Service, its satisfaction with the Service, that the Service is available at all times, uninterruptedly and without errors, the accuracy of the mathematical calculations performed by the Service, and the correction of the errors of the Service.

Neither BLUE-JOBS nor its partners nor its sponsors are liable for any direct, indirect, consequential, special, exemplary, punitive, or other damages arising out of or in any way connected with the use made by the user from service. The user can only solve his dissatisfaction with the Service by not using it and cancelling his account.

If any of the conditions described here are invalidated or cannot be applied, the application of any of the remaining ones should not be affected in any case.

The Terms of Use establish an absolute understanding between you and BLUE-JOBS regarding the Service and prevail over any prior agreement reached between you and BLUE-JOBS. The Terms, and your relationship with BLUE-JOBS under these Terms, shall be governed by the laws of Spain. The user and BLUE-JOBS accept to submit to the exclusive jurisdiction of the courts of Barcelona to resolve any legal question regarding the Conditions.

Blog comment policy

Comments are welcomed and encouraged on BLUE-JOBS website, but there are some instances where comments will be edited or deleted as follows:

  • Comments deemed to be spam or solely promotional in nature will be deleted. Including an external link is not permitted.
  • Comments including profanity will be deleted.
  • Comments containing language or concepts that could be deemed offensive will be deleted. Note this may include abusive, threatening, pornographic, offensive, misleading or libelous language.
  • Comments that attack an individual directly will be deleted.

Job seekers privacy 

Once registered in BLUE-JOBS:

  • (i) Companies will have access to the CV of the Candidate who has registered for the job offer and will see the updated CV.
  • (ii) The Candidate's CV will be visible to all Companies registered on BLUE-JOBS. However, the Candidate may expressly indicate that his/her CV is not visible to Companies when they search the BLUE-JOBS candidate database through the personal profile in the platform.

Account terms

A complete legal name, an email address, and all information required by BLUE-JOBS in the account creation process must be provided.

It is the responsibility of the user to provide truthful information, and BLUE-JOBS reserves the right to delete any account if it is suspected of its veracity or could breach any of the rules of use of BLUE-JOBS.

The user is responsible for maintaining the privacy of his account. BLUE-JOBS shall not be liable for any damage or loss that may be the result of user error in protecting your login information.

The parties accept to legally equate the signature of the client with the signature made by any other type of code, code or element of security identification. Notwithstanding the foregoing, the service provider may require, when deemed necessary, written confirmation to the client.

Blue-jobs services for companies

  1. Start of the service and payment conditions.

The service will come into force at the time when the Company expresses its agreement and acceptance of the legal contracting conditions, and sends us the duly signed request for the service and the Company's file with the payment conditions for the same. Likewise, the Company declares that it has read these conditions in their entirety and accepts them.

In consideration for the service, the Company will pay BLUE-JOBS the amount indicated in the Service Request, always respecting the duration and payment conditions indicated therein. Therefore, the Company is obliged to promptly satisfy all payments due.

BLUE-JOBS reserves the right to discontinue and/or modify the characteristics of the contracted services, migrating them to equal or superior services and informing the Company with a minimum notice of thirty (30) days. However, the Company will have the possibility of terminating the contract without penalty within a period of thirty (30) days from notification of the modification by BLUE-JOBS.

  1. Reasons for resolution

Either party may terminate the contract in the event that the other party ceases to carry out the activities of the corporate purpose, or due to serious breach by the other party of any of the foreseen obligations.

BLUE-JOBS may terminate the contract in the event that the Company breaches any of its obligations contained in these conditions, rules of use and conditions of service, and does not remedy such breach within a period of ten (10) calendar days from notification by BLUE-JOBS. During this term BLUE-JOBS may suspend the service.

In the event of termination of this contract by BLUE-JOBS as a result of the Company's non-compliance, the Company must pay the appropriate amounts for the services provided by BLUE-JOBS up to that time.

  1. Obligations of the Company 

The Company undertakes to make diligent use of the Website and the services accessible from it, in full compliance with the Law, good customs and these Legal Conditions and, where applicable, particular conditions, as well as maintaining the Due respect to other Companies and candidates.

The Company and its personnel with access to BLUE-JOBS must maintain due secrecy regarding all information included in BLUE-JOBS, especially candidate information.

The Company must select the identifier and password, information that it agrees to keep and use with due diligence.

The use of the password is personal and non-transferable, and transfer, even temporary, to third parties is not permitted. In this sense, the Company must adopt the necessary measures to safeguard the selected password, avoiding its use by third parties. Consequently, the Company is solely responsible for the use of your password, with complete indemnity for BLUE-JOBS. In the event that the Company knows or suspects the use of its password by third parties, it must inform BLUE-JOBS of this circumstance as soon as possible. The aforementioned registration will be carried out in the manner expressly indicated in the service itself.

All information provided by the Company through the services must be truthful. For these purposes, the Company guarantees the authenticity and veracity of all data communicated as a result of completing the forms necessary for subscribing to the Services.

Likewise, it will be the Company's responsibility to keep all the information provided to BLUE-JOBS permanently updated so that it responds, at all times, to the real situation of the Company. In any case, the Company will be solely responsible for any false or inaccurate statements made and for any damage caused to BLUE-JOBS or third parties due to the information provided.

The Company undertakes to respect applicable laws and the rights of third parties when using the contents and services of the Website. Likewise, the reproduction, distribution, transmission, adaptation or modification, by any means and in any form, of the contents of the Website (texts, designs, graphics, information, databases, sound and/or image files, logos, etc.) and other elements of this Website, except with prior authorization from its legitimate owners or when permitted by law.

The Company is solely responsible for the relationships it establishes with the rest of the members of InfoJobs. BLUE-JOBS reserves the right to limit the number of contacts the Company establishes with other members and, in certain circumstances, prohibit communications with other candidates or Companies through the Services offered by InfoJobs or otherwise limit its use of such Services.

BLUE-JOBS, likewise, reserves the right to monitor conversations and disputes that may occur between candidates and/or Companies and, if it deems necessary, to restrict, suspend or close the Company's account if it considers, its sole discretion, which is necessary for the correct compliance with these Legal Conditions.

By way of illustration and not limitation, it is prohibited to: use libelous or slanderous content, regardless of whether such content affects other candidates or Companies, or use pornographic content or content that violates the laws for the protection of minors, or advertise, offer or distribute pornographic products or that violate laws for the protection of minors, harass other candidates or Companies (especially through spam), use legally protected content (e.g. by legislation relating to intellectual property, trademarks, patents, models utility or aesthetic models) without having the right to do so, or advertise, offer or distribute legally protected goods or services, as well as carry out or promote actions contrary to free competition, including those aimed at progressively attracting customers (such as systems in chain, snowball or pyramidal).

  1. Service and pricing modifications

BLUE-JOBS reserves the right to modify or suspend, temporarily or permanently, the Service at any time for any reason with or without notice if it deems it convenient. BLUE-JOBS reserves the right to change fees with a notice of 15 days. Notification of quota changes will be posted on BLUE-JOBS’s website and in writing.

ACTIVITIES OR ACTIONS EXPRESSLY PROHIBITED

The Company is expressly prohibited from taking the following actions:

  • Use mechanisms, software or scripts in relation to the use of the Website as well as attempt to decipher the encryption keys, systems or algorithms or any other security element.
  • Use web scraping tools, automatic data extraction robots, data extraction add-ons or plug-ins and similar that put the security and protection of personal data of Infojobs at risk.
  • Block, overwrite, modify or copy, unless this is necessary for the correct use of the website services. For example, copying using "Robot/Crawler" type search technologies is not necessary for the correct use of the Website's services, so it is expressly prohibited.
  • Disseminate, reproduce or publicly communicate content from the InfoJobs Website, Companies, candidates or third parties, without the prior authorization of the rights holder.
  • Any action likely to impair the functionality of the BLUE-JOBS infrastructure, especially to overload it.
  • Use any of the materials and information contained on this Website for illegal purposes and expressly prohibited in these Legal Conditions, as well as the particular conditions that, where appropriate, are enabled that are contrary to the rights and interests of BLUE-JOBS, its members and/or third parties, and must respond to them in the event of contravening or failing to comply with said obligations and/or that, in any way (including the introduction or dissemination of "computer viruses"), damages, disables, overloads, deteriorates or prevents the normal use of the materials and information contained on the Website, the information systems or the documents, files and all types of content stored on any computer equipment (hacking) of BLUE-JOBS, its members or any registered user, individual or organization.
  • Use or attempt to use another person's account or create a false identity on BLUE-JOBS.
  • Disclose or provide information protected by law due to contractual or fiduciary relationships (such as having inside information or information that is proprietary to another person and confidential under an employment relationship or confidentiality agreement).
  • Share or provide to third parties not linked to BLUE-JOBS information related to access ports, access key and user identifier or any other information related to access permissions to Infojobs.net. Likewise, allow access to your Private Company Menu to natural or legal persons not validated by Infojobs. In this sense, as a Company, you undertake to keep your access codes to the Infojobs service secret and not share them with third parties.
  • Use information, content or other data viewed or obtained through BLUE-JOBS to provide services that, in BLUE-JOBS' sole discretion, compete with BLUE-JOBS.
  • Request candidates to register on third platforms without express approval from BLUE-JOBS, as well as condition the continuity of the selection processes, initiated through Infojobs, on the Candidate's registration on a platform other than BLUE-JOBS.
  • Send messages to candidates in bulk or for commercial, promotional or advertising purposes.
  • Transfer candidate information and their CV outside the BLUE-JOBS platform and that has not been previously permitted by Infojobs.net. The Company's permissions as a user of the BLUE-JOBS platform will be conditioned on the duration of the service and the type of service contracted. The Company will not be able to manage the CV of candidates outside the management area of ​​the BLUE-JOBS platform.
  • Use candidate information and BLUE-JOBS resources for activities that are not directly related to the contracted service.

The Company that intentionally or negligently fails to comply with any of the foregoing obligations will be liable for all damages caused by non-compliance with the obligations and may result in the blocking of the Infojobs service. If applicable, BLUE-JOBS may propose precedent measures in the event of non-compliance with these prohibitions so that they cease and are corrected immediately.
